Terms of Service
Last updated: 26 October 2026
These terms apply when you use the Perpetual Marketing website (perpetual.marketing) or connect a social media account to our content publishing tools, including our Perpetual Publisher app. By using either, you agree to these terms. If you don't agree, please don't use them.
1. Our services
We run paid social, content and digital sales systems for businesses, and partner with creators to launch products. The details of any paid engagement (scope, fees, deliverables and responsibilities) are set out in a separate written agreement with each client or creator. If that agreement conflicts with these terms, the agreement wins.
2. Using this website
- The content on this site is for general information. It is not tailored advice for your business, and results we describe from past work are not a promise of future results.
- You may view and share pages from this site, but you may not copy, republish or sell our content, branding or designs without our written permission.
- You must not misuse the site: no attempts to break in, overload it, scrape it at scale, or submit false or harmful information through its forms.
- We may change, pause or remove any part of the site at any time.
3. Our publishing tools
We use our own software to schedule and publish content to social media platforms such as TikTok, Instagram, Facebook, LinkedIn and YouTube. These tools are used only by Perpetual Marketing and are not offered for sale to the public.
- Who can be connected. We connect only accounts that we own, or accounts whose owners have authorised us in writing to manage them. By connecting an account, you confirm you have the right to do so.
- What we do with access. We use access only to upload, schedule and publish the content agreed with the account owner, and to report on how that content performs. Our Privacy Policy explains exactly what data we access and how we protect it.
- Content responsibility. The account owner is responsible for approving content before it is published and for making sure it does not infringe anyone's rights. We do not publish content the owner has not approved.
- Platform rules. All content we publish must follow the relevant platform's own terms and guidelines, including the TikTok Terms of Service, Instagram Terms of Use, LinkedIn User Agreement and YouTube Terms of Service. Using YouTube API Services through our tools means you also agree to the YouTube Terms of Service.
- Disconnecting. You can revoke our access at any time from the platform's settings or by emailing us. We then stop publishing and delete the stored access tokens within 30 days.
- Platform availability. Social media platforms can change or restrict their APIs, reject or delay posts, or change how content is shown. We are not responsible for a platform's decisions, outages or changes.
4. Intellectual property
The Perpetual Marketing name, logos, website content and our software belong to Perpetual Marketing Ltd. Content you give us to publish stays yours. You give us permission to copy, edit and publish it only as needed to provide the agreed service.
5. Links to other sites
This site links to third-party websites and platforms. We don't control them and aren't responsible for their content or how they handle your data.
6. Liability
We provide the website and our tools "as is". We work hard to keep them accurate and running, but we don't guarantee they will always be available or error-free.
We are not liable for indirect or consequential losses, or for loss of profit, revenue, data or business opportunity arising from your use of the website or our tools. For paid engagements, our liability is set out in the client agreement. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under English law.
7. Changes to these terms
We may update these terms from time to time. The date at the top shows when they last changed. Continuing to use the site or our tools after a change means you accept the updated terms.
8. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute.
